I charge my family, my children, my brothers, and sisters to be conscious of Allah; fear His punishment; fulfil His commands; do not allow life to beguile you; and do not allow the devil to beguile you with respect to Allah. I commend you to adhere to your prayer, for this is the first thing which you will be brought to account for on the day of resurrection. I commend you to have compassion and love for each other and that no desertion fall amongst you or any dispute "And hold fast to the rope of Allah all of you and do not disperse" "My son: "Allah has indeed chosen for you the religion, so do not die except that you are Muslim."" I clear my conscience before Allah Most High, I charge you with fulfilling my will and do the following: 1 - When my time comes close, and my departure is near, that you point my face towards the Qibla (that is place me on my right side facing Mecca), and that you remove from the area where I am dying any whose presence causes injury to the angels, whether a person who is unclean (from not washing completely after having a sexual encounter whether in a dream or in reality), or a dog, or a statue, or a menstruating woman. Whoever sits with me must continually mention Allah and supplicate for me, as the angels say Amen to the supplications. 2 - That some of the righteous scholars attend to help me repeat the two testimonies (That is, I bear witness that there is no god except Allah and I bear witness that Mohammad is the messenger of Allah) in a gentle manner, and let my last words be: "There is no god except Allah." 3 - Let some of the righteous read or recite Sura Yaseen (Sura no. 36 of AlQur'an AlKareem) in a low voice, in accordance with the statement of the words of the messenger (peace of Allah and His blessings upon him): "Recite Sura Yaseen over your dead." 4 - That whoever attends reminds me of the breadth of the mercy of Allah Most High, and to suspect well in Him, and to utter the word of Unity (That is, there is no god Except Allah) and that my eyes are closed and they must say: "Bismillah Wa'ala Millati Rasulillah" (In the name of Allah, and according to the religion of the messenger of Allah), and to supplicate for me with forgiveness, mercy, and steadfastness. 5 - When I die, the following must be done: My eyes must be closed, my beard or chin tied with a kerchief closing my jaw, my outer clothes removed and I must be covered with a different cover, I also completely forbid any waling, moaning, face slapping, clothes tearing, or wearing black. I also forbid any unclean person (unclean from not washing completely after having a sexual encounter whether in a dream or in reality), or menstruating woman to attend. I also demand that no person shall kiss me who was not permitted to kiss me whilst I was alive. I also require that there will be no mourning or condolence after three days. 6 - To hasten to repay any debt which I may have, to be paid from my estate and this is: __________________________________________________________________________________ __________________________________________________________________, and to pay my funeral and testamentary expenses including duties both Federal and State on the whole of my real and personal estate. I hold in trust, the following which must be returned to their owners: ___________________________________________________________________________________ ___________________________________________________________________________________ 7 - To hasten my preparation and my burial, and to have _________________ responsible for washing me, but if he / she is not available, then some of the righteous people. I also forbid the sacrifice or killing of any animal before my casket or grave as this is not permitted in Islam. 10 - Then, when you bury me, ___________________ must enter my grave with me, then put me on my right and point my face to the Qibla (The direction of Mecca), and you must lift my head and place some dirt under it to keep it raised, then to throw dirt over my body in three handfuls saying with the first: "Minha Khalaqnakum" (From it We created you), with the second: "Wafeeha nu'idukum" (and in it we return you), and with the third: "Waminha Nukhrijukum Taratan Ukhra" (And from it we issue you forth a second time). Then they must say: "Bismillah Wa'ala Millati Rasulillah Sallalahu 'alalyhi Wassalam" (that is, in the name of Allah and in accordance with the religion of the messenger of Allah (peace of Allah and His blessings upon him). Then when my burial is finished, those present must stand by my grave and supplicate Allah Most High to forgive me, grant me strength in resolve, have mercy upon me, and to make my grave a meadow of the meadows of Janna (Paradise). then you must remain by my grave for an hour supplicating Allah to forgive me, because I will feel easy with your company until I talk with the angels of my Lord. 11 - That my grave is not raised above the ground more than one hand span so that its place is known. However, I forbid for any image or statue to be erected over my grave, and forbid for any statue or monument to be erected anywhere in my commemoration. 12 - I charge the children with the fear of Allah - Exalted and Elevated - and that they are not fooled with the worldly life, and to supplicate the mercy of Allah for me, and not to forget me after my death with giving charity in my memory, and supplicating for me, and visiting my grave particularly on Fridays and to recite of Sura AlIkhlas (Sura 112 of AlQur'an AlKareem) eleven times. 13 - My money, wealth, and estate must be distributed as Allah Exalted and Elevated commanded in His holy Qur'an, a sum of ___________________ from my estate will be set aside for _______________ to be paid (annually, monthly, fortnightly, weekly* ) as a running charity to be spent on the poor, impoverished, orphans, or the righteous Muslim organisations. 14 - If I die before fulfilling the obligation of Hajj (pilgrimage to Mecca), one of my children must fulfil this obligation on my behalf from my money, or if these are not sufficient, then from his. I clear my conscience with Allah from any religion other than Islam, or any words which contradict the words of the chosen one (Mohammad, peace of Allah and His blessings upon him). This is my will, I place it as a trust on the consciences of my children, my spouse(s)* , my brothers, and all my family, and I will question them about its fulfilment on the day of resurrection. Allah Most High said: "So whoever changes it after hearing it, its crime is upon those who change it, truly Allah is All-Hearing, All-Knowing." So whoever changes my will or refuses to fulfil it, his account is with Allah, and those have a wrath from the Lord of the worlds. We supplicate Allah Most High to make us die in belief, and make our end better, and may Allah grant His Peace and blessings upon His messenger Mohammad, his family, and companions. You may appoint more than one person as Executor. 3 - If you wish to dispose of all your property in one gift, it is unwise to attempt to list all your assets, but the words "all of my real and personal estate" should be used. 4 - If you wish to give some specific gift or gifts, for example; "$1000.00" Or "My books", make these gifts first and then use the words "all the rest and residue of my property including any gift devise or bequest which lapses or fails to the effect I GIVE DEVISE AND BEQUEATH unto ______". 5 - A Will should be written in ink, and MUST be signed by the Testator at the foot of the last page of writing in the presence of two witnesses, who MUST also sign their names in the Testator's presence and in the presence of each other in the places provided in this form. IT is advisable but not essential, that the witnesses insert their address and occupations and that the Testator and the witnesses use the same ink. 6 - Avoid alterations if possible; it is better to make another Will. If any alterations or insertions are made, the Testator and both witnesses must initial them in the margin opposite otherwise the alterations or \insertions will not be effective. 7 - Do not attempt to make codicil to your Will. It is better to make another Will. 8 - Persons under the age of 21 years cannot make a Will, except soldiers engaged on war service and seamen at sea. 9 - Be careful in choosing the witnesses to your Will because a gift to a witness or to the husband or wife of a witness is void. Any other person can witness your Will and need not know the contents but should know that it is your Will. 10 - A Will made before marriage becomes void automatically after marriage unless the Will includes the words "and I make this Will in contemplation of my marriage with (insert name of intended husband or wife)". 11 - A gift to a person becomes void if he or she dies before the Testator, except in the case of a gift to your child or grandchild. In these cases, if the child or grandchild predeceases you and leaves a child or children who survive you, the gift will not become void, but will pass in accordance with the will (or as an intestacy) of your child or grandchild who predeceased you. 12 - Avoid the use of technical legal phrases.
